By participating in or attending any event organised, facilitated, or managed by Cirquedubleurgh (the “Company”), the client, participants, and attendees (collectively referred to as “Participants”) acknowledge and agree to the following terms:
1. Assumption of Risk
- Participants understand and acknowledge that certain events organized by the Company, including but not limited to fire performances, wedding celebrations, and corporate events, may carry inherent risks, including, but not limited to, injury, property damage, or fire hazards.
- Participants voluntarily assume all risks associated with attending or participating in these events and waive any claims against the Company, its employees, agents, performers, contractors, and affiliates (collectively, the “Company Representatives”).
2. Health and Safety Precautions
- The Company takes reasonable steps to ensure the safety and well-being of all Participants. However, Participants acknowledge that they are responsible for their own health and safety and agree to follow all safety guidelines and instructions provided by the Company and the venue.
- In the case of events involving fire or pyrotechnics, Participants agree to stay within designated viewing areas and avoid restricted areas at all times.
3. Limitations of Liability
- To the fullest extent permitted by law, the Company and Company Representatives shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or related to any event organized by the Company. This includes, but is not limited to, personal injury, property damage, or loss suffered by Participants.
- The Company is not responsible for any disruptions, cancellations, or changes to events due to unforeseen circumstances, including but not limited to inclement weather, venue restrictions, or government regulations.
4. Insurance Coverage
- The Company holds general liability insurance; however, Participants acknowledge that this coverage may not extend to all individual incidents or personal property. Participants are encouraged to obtain their own personal insurance coverage for any specific needs or concerns.
5. Release of Photography and Media Rights
- By attending a Company event, Participants consent to be photographed, filmed, or otherwise recorded by the Company or authorized third parties. The Company retains all rights to these materials for promotional, advertising, and other purposes without compensation to Participants, unless otherwise specified in a separate agreement.
6. Indemnification
- Participants agree to indemnify, defend, and hold harmless the Company and Company Representatives from any and all claims, liabilities, damages, expenses, and losses, including reasonable attorney fees, arising out of or resulting from their own actions, negligence, or failure to adhere to event guidelines.
7. Acknowledgment of Terms
- By booking or attending an event with the Company, Participants acknowledge that they have read, understood, and agree to abide by this Disclaimer and Liability Waiver in its entirety.
